Insight into patents

We have blogged before about the ‘patent wars’ between Apple and Samsung, and discuss the role that patents have in new product development on page 319 of our book.  Today the BBC reports on a conference taking place in Geneva to discuss the effect that patent protection may have on innovation.  More specifically they are discussing FRAND – fair, reasonable and non-discriminatory patents.   These relate to products that are essential for an industry standard to exist.  For instance, the technology to support the 3G telecoms network or the software that enables access to Jpeg photos.  With these kind of patents, the licence holder must allow any third-party to use the innovation and agree to a fee that is not excessive. Problems arise when two or more parties cannot agree on what is ‘fair’ and ‘reasonable’.
